Patient Dies After Doctor Removes His Entire Kidney Instead Of His Kidney Stones

A consumer court in Gujarat has ordered a hospital to pay Rs 11 lakh compensation to the kin of a patient who died after a surgery for kidney stones. Instead of clearing the stones, the doctor at the hospital removed the patient's left kidney which led to his death.

The incident took place at KMG General Hospital in Balasinor area of Mahisagar district of Gujarat in 2011. The deceased was identified as Devendrabhai Raval. 
 
The Gujarat State Consumer Dispute Redressal Commission disposed of the matter and ordered the hospital to pay Rs 11.23 lakh as compensation to the family of the deceased citing medical negligence. The verdict came following an appeal by the victim's family, according to a report in India Today. 

The victim, a resident of Vanghroli village in Kheda district, had complained of severe back pain and difficulty in passing urine. The patient consulted Dr Shivubhai Patel at KMG Hospital who diagnosed a kidney stone measuring 15mm in his left kidney. 

He was later operated upon in September 2011. However, after the surgery, the doctor told Raval's family that he had to remove the patient's kidney instead of stone citing patient's well-being. 

Raval faced further problems after kidney removal and was admitted to a kidney hospital in Nadiad in Kheda district. Following further complications, Raval was referred to Institute of Kidney Disease and Research Centre (IKDRC) in Ahmedabad. He succumbed to renal complications during treatment on January 8, 2012. 

"The employer is responsible not only for his own acts of commission and omission but also for the negligence of its employees so long as the act occurs within the course and scope of the employment," the report said citing Gujarat State Consumer Dispute Redressal Commission's observation.

The court ordered the hospital to pay compensation with 7.5 per cent interest rate since 2012 to Raval's family.
