Ministry of Justice Enforces a Three-Month Suspension on the Real Estate Company

The Real Estate Brokerage Department at the Ministry of Justice has issued a three-month suspension on a real estate company's operations, starting today, for violating the provisions of Law No. 22 of 2017, which governs real estate brokerage activities.

In a statement, the department clarified that the decision followed the confirmation of this violation, in accordance with Article No. 14 of the law, which prohibits real estate brokers from engaging in any brokerage activities, advertising property for sale, purchase, or lease, or conducting any related transactions unless the necessary documents are completed.

This measure is part of the inspection campaigns carried out by the audit and control section at the Real Estate Brokerage Department to monitor violations and perform regular workplace inspections, the statement noted.

The Real Estate Brokerage Department emphasized that drafting real estate brokerage contracts is mandatory, and external property advertising is prohibited unless the documents are completed and submitted to the department for verification, ensuring the credibility of external advertisements within the scope of real estate brokerage.

Khalid Hassan Al Mehshadi, Director of the Real Estate Brokerage Department at the Ministry of Justice, highlighted the importance of brokers adhering to the licensing conditions and regulations under which licenses are granted. He affirmed the department's commitment to enforcing the brokerage law provisions to regulate the real estate brokerage profession, promoting the profession, and protecting customers' rights.

He reiterated that licensed real estate brokerage offices must fully comply with the provisions and regulations specified in the real estate brokerage law and the procedures through which companies and real estate brokers are trained before obtaining their licenses.

The required documents from real estate brokers to carry out brokerage activities include a written brokerage contract and a certified copy from the property owner, an approved cadastral map from the relevant authority, and proof of the parties authorized to handle transactions.

Additionally, a certificate from the Ministry of Justice's Real Estate Registration Department must be obtained, clarifying the property's condition, restrictions, transactions, and any other information that the other contracting party must be aware of, which may affect their decision, along with several other documents that may be updated according to the requirements of practicing real estate brokerage.
